2. APPLICABILITY & APPLICATION OF LAW

2.1. These Terms apply to all visitors, users, and customers accessing or using our website or purchasing automotive parts and related services from Koreanboyz.

2.2. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

3. PRODUCTS & INVENTORY

3.1. Koreanboyz specializes in supplying both new and used (second-hand) automotive spare parts for various vehicle brands (including but not limited to Hyundai, Kia, Mercedes, Renault, Honda, Peugeot, and Tata).

3.2. Product Descriptions: Images, diagrams, and descriptions on our website or provided via messaging platforms (e.g., WhatsApp) are for illustrative purposes. While we strive for accuracy, actual used parts may vary in appearance, wear, or cosmetic finish.

3.3. Compatibility: It is the customer’s responsibility to verify that the part ordered is compatible with their specific vehicle make, model, year, and engine specification prior to purchase or installation.

4. QUOTATIONS, ORDERS, & PAYMENTS

4.1. Authorized Representatives: All official quotations, sales, and banking details will be communicated directly by authorized representatives listed on our website.

4.2. Payment Methods: Payments must be made via approved payment channels (e.g., direct EFT, card payments, or cash on collection where applicable).

4.3. Payment Verification: Goods will only be dispatched or released once funds have cleared in Koreanboyz’s bank account. Koreanboyz reserves the right to cancel any transaction suspected of fraud or unauthorized payment.

5. DELIVERY & COLLECTION

5.1. Free Local Delivery: Free delivery is available for eligible orders over a specified amount (e.g., R1,000) within designated zones in and around Cape Town, subject to change without notice.

5.2. Out-of-Zone Shipping: For deliveries outside specified local zones, courier/freight charges will be quoted separately and are payable by the customer.

5.3. Risk & Ownership: Risk in the goods passes to the customer upon physical delivery or collection. Title/ownership of goods remains with Koreanboyz until full payment is received.

6. RETURNS, REFUNDS, & WARRANTIES

6.1. Used Parts Warranty: Unless otherwise specified in writing at the time of purchase, used automotive parts are sold in working condition as inspected.

6.2. Defects & Claims: Any claim regarding defective or incorrect parts must be submitted to Koreanboyz within 7 days of receipt with proof of purchase and photographs/details of the issue.

6.3. Exclusions: Warranties do not cover damages resulting from:

  • Incorrect installation or fitting by unqualified technicians.

  • Misuse, modification, racing, or alteration of the part.

  • Normal wear and tear.

6.4. Electrical Parts: Due to the nature of auto-electrical components, electrical parts (e.g., ECUs, sensors, wiring harnesses) are subject to testing prior to sale and may carry specific non-return or limited-return conditions.

6.5. Refund Processing: Refunds (where applicable under the CPA) will be processed using the original payment method, excluding third-party delivery costs unless the return is due to an error by Koreanboyz.

7. LIMITATION OF LIABILITY

7.1. To the maximum extent permitted by South African law, Koreanboyz, its directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of the purchase, use, failure, or installation of any part sold.

7.2. Koreanboyz’s total liability for any claim arising out of a sale shall not exceed the purchase price of the specific part in question.

8. USE OF THE WEBSITE & INTELLECTUAL PROPERTY

8.1. All content on https://koreanboyz.co.za/ (including text, logos, graphics, and layout) is the property of Koreanboyz or its content suppliers and is protected by South African intellectual property laws.

8.2. Vehicle manufacturer names, brand logos, and trade names (e.g., Hyundai, Kia, Mercedes) mentioned on the website are used solely to identify the vehicles for which parts are supplied and do not imply official affiliation with or endorsement by those manufacturers.

9. PRIVACY & PROTECTION OF PERSONAL INFORMATION (POPIA)

9.1. Koreanboyz collects and processes personal information (such as your name, contact details, delivery address, and vehicle details) strictly for business operational purposes, order fulfillment, and customer service in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

9.2. We do not sell, rent, or share your personal information with third parties except as necessary to complete your order (e.g., courier partners).

10. AMENDMENTS

Koreanboyz reserves the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will take effect immediately upon being posted on this website.
